Terms of use

Ocasia is run by Kanea Studio Ltd, a company registered in England and Wales (number 15458475). You can reach us at team@ocasia.app.

• You must be 18 or over to organise an event or buy anything in the app.
• You must be 13 or over to join an event as a guest.
• If you organise an event where children under 13 are present, you are responsible for making sure they do not use Ocasia.

Organisers sign in with their email address and a one-time code. Keep access to your email secure, because anyone who can read it can sign in as you.

Guests do not create an account. Your place at an event is tied to your phone, so if you delete the app or lose the phone before the event is developed, you may lose access to it.

If you organise an event, you decide who gets the invite, how many shots each guest has and when the album is developed. Anyone with the invite link or code can join, so share it only with people you want there.

You are responsible for the event you run: telling your guests that it uses Ocasia, dealing with reports, and removing shots or guests that break these terms. You can remove any shot and any guest from your event at any time.

You own the photos and videos you take. By taking them in Ocasia, you give us permission to store, process and show them to the organiser and the guests of that event, only to run the service. That permission ends when the shots are deleted, apart from copies other people have already saved to their phones.

By taking a shot at an event, you also let its organiser and guests view it once the album is developed and save it for their own use.

You confirm that you have the right to take and share each shot, and that the people in it would not reasonably object to it being shared with the event.

We have zero tolerance for objectionable content and abusive users. You must not take or share anything that:

• sexualises or exploits children in any way. We report it to the authorities.
• shows nudity or sexual activity without the consent of everyone in it.
• threatens, harasses, bullies or humiliates anyone.
• promotes violence, or hatred against people for who they are.
• is illegal, or infringes someone else's rights, including their privacy or copyright.
• has nothing to do with the event, such as spam.

You must not misuse Ocasia either: no attempts to get round its limits, access other people's events, overload or reverse engineer the service, or pretend to be someone else.

Anyone at an event can report a shot in the app. A shot three guests report is hidden until the organiser reviews it, and organisers can remove shots and guests. You can also report content to us at team@ocasia.app. We act on reports of objectionable content within 24 hours, and we may remove content and suspend or end the access of anyone who breaks these rules.

Some features, such as room for more guests at an event, are one-off in-app purchases for a single event. Apple charges them at the price shown before you buy, and Apple's terms apply to the payment.

A purchase takes effect as soon as Apple confirms it. Refunds are handled by Apple through its refund process. Nothing in these terms affects your statutory rights as a consumer.

We work to keep Ocasia running and your shots safe, but we cannot promise it will always be available or free of faults. We may change, add or remove features. If a change takes away something you have paid for, we will give you a fair remedy.

Events and albums are deleted 12 months after the event ends. Save anything you want to keep before then.

You can stop using Ocasia at any time. Organisers can delete their account in the app, from Profile.

We may suspend or end your access if you break these terms, if the law requires it, or if your use puts other people or the service at risk. Where it is reasonable, we will tell you why.

We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, for business losses, or for content other people take or share.

If digital content we supply damages your device or other digital content, and that is caused by our failure to use reasonable care and skill, we will repair the damage or pay you compensation.

Otherwise, our total responsibility to you is limited to the greater of what you paid us in the 12 months before the claim and £100.

Nothing in these terms limits our responsibility for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

These terms are between you and us, not Apple. Apple is not responsible for Ocasia or its content, and has no obligation to provide support for it. Apple and its subsidiaries may enforce these terms against you as third-party beneficiaries.

When we change these terms we update the date at the top. If a change is significant, we will tell you in the app before it takes effect. If you keep using Ocasia after that, you accept the new terms.

These terms are governed by the law of England and Wales, and disputes go to the courts of England and Wales. If you live elsewhere in the UK or in the EU, you can also bring proceedings where you live, and you keep the consumer protections of that country's law.
